This Licence to Store Agreement (“Agreement”) is made between:

1. The Owner: Walker Home & Garden Centre Ltd, 361 Argyll Street, Dunoon, PA237RN
2. The Licensee: Customer

1. Grant of Licence

The Owner grants the Licensee a personal licence to use a storage unit for storing the Licensee’s goods.

This licence does not create a tenancy or give the Licensee any property rights in the Unit.

2. Term and Fees

  • The licence starts upon entry and continues on a monthly rolling basis until terminated by either party.
  • The Licensee shall pay a monthly storage fee payable in advance
  • Late payments may incur interest at 10% per month or a fixed late fee.
  • Replacement keys, if required, will incur a charge of £5 per key.

3. Use of the Unit

The Licensee agrees:

  1. To store only lawful, dry, and safe goods.
  2. Not to store flammable, explosive, hazardous, perishable, illegal, stolen items, living animals or plants.
  3. To use the Unit solely for storage purposes and not as living accommodation or business premises.
  4. To keep the Unit clean and in good condition.
  5. To ensure goods are adequately insured; the Owner does not insure stored goods. The Owner recommends adequate insurance covering theft, fire, flood, and accidental damage.
  6. The Owner is not responsible for loss due to theft or vandalism.

4. Access

  • Normal access hours: Monday to Saturday: 9am to 5.30pm, Sunday 12pm to 5pm. Unless prior agreement with The Owner
  • The Owner may restrict access temporarily for maintenance, safety, security reasons or unpaid fees.
  • The Owner may enter the Unit in emergencies, for inspections, or as required by law.

5. Owner’s Rights

  • The Owner may terminate the licence if fees remain unpaid for more than 30 days or if the Licensee breaches the Agreement.
  • The Owner may move goods to another suitable Unit if necessary.
  • Goods may be sold or disposed of if the licence is terminated and the Licensee fails to remove them after reasonable notice, in accordance with the SSA UK Code of Practice
  • The Owner may recover costs of disposal from the Licensee.

6. Liability

  • The Owner is not liable for loss or damage to goods except where caused by proven negligence.
  • The Licensee is responsible for insuring goods against theft, loss, or damage
  • The Licensee must keep the Unit clean and report damage immediately.

7. Ending the Agreement

  • Either party may terminate the licence by giving 7 days’ written notice.
  • Upon termination, the Licensee must remove all goods, leave the Unit clean and empty and return any keys provided.
  • Abandoned goods may be disposed of according to UK law and the SSA UK Code of Practice.

8. General

  • This Agreement is personal to the Licensee and may not be assigned.

  • This Agreement is governed by the laws of Scotland.
